We are Continental Games, LLC, of Wilmington, Delaware, a licensed retailer of playing cards, poker chips, games and equipment made by casino industry manufacturers. These web pages are an internet platform for the sale of a line of fine casino chips, playing cards and accessories called "Key West Resort & Casino," a fictional name used on those chips, playing cards and accessories. Requesting quotes:
Visitors to our site interested in purchasing Key West Resort & Casino chips or other items may request that we quote the retail cost and shipping fees for their intended order before purchasing. This service is provided as a courtesy to our customers, and the following rules apply to quotes:
Expiration: When requested, we will quote the retail price and shipping cost of our items, delivered to our customer. The quote is considered valid for 14 calendar days after we deliver the quote to the customer.
Price quoted: We will not increase the price of our items sold to a customer with an outstanding, unexpired quote. If we quote the price of an item and raise the price of the item within 14 days of the quote, it will be sold to the customer at the quoted price. If the quoted customer returns after more than14 days to purchase an item, they will be charged the price on the day of purchase.
The quote is not a contract. We reserve the right to refuse to sell our items to any customer at any time if we believe, based on their communications, requests, or other aspect of their interaction with us, to be purchasing items with the intent of using the items to engage in illegal activity, disrupt or otherwise harm our business, or disparage our products.
The quote is not an agreement to hold goods in stock. If a customer requests a quote for items in stock, we will quote from our stock on the day of the quote. If the customer delays in purchasing the items and we receive a paid order for those items, they will be sold and shipped to the customer who paid for them. Depending on our company's inventory, this may result in some delay in filling the order for the customer first quoted.
Quotes will not be honored if the customer changes the items, quantity, or shipping destination. We reserve the right to correct the total due when the customer changes any aspect of their order.
A customer who states they intend to place an order but does not place an order is considered as a customer who has received a quote.

Conditions of purchase:
When you conduct a transaction with us, both parties agree to certain things, noted in A through F, below.
A. Payment of an order or invoice confirms your order
When you place an order on our site and pay for your order, your payment is your confirmation that the order is correct and complete and that all information on your invoice is correct. The order you for which you paid will be the order shipped to you. If you need to correct an order, you should immediately email [email protected]. Emails requesting corrections of an order after the order is shipped cannot be honored, as the items will have already been shipped to you. When you receive these items, you should return them and order the correct items. This will be considered an "exchange." If you email your order to us or use our order form to place an order with us, and then receive an invoice from us and pay the invoice, your payment of the invoice also confirms that your order is correct and complete. The items listed on the invoice will be the items shipped to you. If you need to correct an order made this way, you should immediately email [email protected]. If the order has been shipped, the order cannot be corrected. When you receive these items, you should return them and order the correct items. This will be considered an "exchange." B. Exchanges If you order an item and then decide you'd like to exchange the item by returning it to us and receiving a different item you agree to assume all costs for shipping the items back to us, for re-shipping new items to you, and to pay the difference, if any, in cost between the original item(s) and the items in your later order. If the replacement item costs less than the original item, you may receive a refund, less our costs incurred in the transaction. C. Our duty to complete your order All goods sold are Free on Board Origin, Wilmington, Delaware, USA. When we package, correctly address and ship your order, you agree that our duty to complete your order has been satisfied. Ownership of the items in your shipment transfers to you when it is handed over to the carrier entrusted with the shipment. D. Insurance Within the United States, Canada, the United Kingdom and certain other countries, insurance is available at cost through the United States Postal Service or United Parcel Service (UPS). Packages shipped via Priority Mail are insured for their value up to $50 at no extra cost. If the value of your order is more than $50, you may request to insure your package for up to its full value for an additional cost. This request must be made at the time of your order by emailing the request to [email protected]. If you do not expressly request such insurance and pay any required insurance cost at the time of your order, you are waiving such insurance. E. Orders lost, stolen or damaged in transit or upon arrival Our company is not responsible for items lost, stolen or damaged during shipping or immediately following delivery to your address. We package our items correctly in industry-standard boxes to prevent damage, tampering or theft. In the unlikely event that your package is damaged, lost or stolen while in possession of a carrier or upon arrival at your address, we will assist you in locating it or making the necessary insurance claim with the carrier. As the recipient, you must make the claim for loss, theft or damage. Claims for lost, stolen or damaged items must be made with the carrier within a reasonable time, so we ask that you open and inspect your order when it arrives, and contact us as soon as possible if you wish to claim any loss due to an item which has been damaged or stolen. You must make this claim within 10 days of its arrival to your address. After 10 days, we assume that you have opened and inspected your items and found them to be in good condition. In all cases where theft of the package occurs in transit or after delivery, you must file a crime report with the appropriate jurisdictional agency. F. Tariffs, VAT, import tax customs fees or other import fees: When a buyer requests their items be shipped to an address outside the United States, the buyer is responsible for payment of any tariff, tax or other fee charged by the carrier or the government of the buyer's home country in order to import the products, or for the products to clear customs in the destination country. G. Theft after delivery Our company is not responsible for theft of or damage to any order after the carrier has delivered the item to the address you requested. We will rely upon the documentation provided by the carrier to prove delivery took place. If your address is an apartment, business office or other location where mail is left in any unsecured place, you may request shipment to a business or other address where it may be securely received or stored upon receipt. In such cases, we will assist you to the extent possible in searching for and recovering your stolen items. In order for us to assist you, you must first report the theft of your order to law enforcement and provide proof (a police report of theft of your order) to us. H. Customer agrees to lawful use: By purchasing equipment from us, you expressly state, affirm and agree that you are not prohibited by law from owning the item(s) in you state and local jurisdiction, or have a specific exemption from any such prohibition, such as a license, and will use the items in accordance with all laws. We will not sell gaming equipment to anyone we believe to be using the equipment to engage in illegal gambling. We reserve the right to cancel any order if we determine that shipping the order to you will violate your state law regulating certain gambling devices. (For example, we cannot ship roulette wheels to addresses in New York.) We believe that learning the strategies of various games is educational and that all games may be played solely for enjoyment by players of all ages. We recognize that many card games are played socially for points only, and we sell our playing cards, casino chips and dealer buttons openly. We restrict the sale of certain other professional casino gaming items to adults, and require an adult signature upon delivery of those items. If requested, we will assist you in determining the legality of a home game or event in your area. Upon request, we will ban from our site any person who requests to be banned due to gambling addiction. I. Customer expressly agrees to hold harmless Continental Games, LLC By purchasing equipment from us, you expressly agree to hold harmless Continental Games, LLC, its owner, agents, and employees, in any dispute in the courts of the United States, of any state or local jurisdiction, or of other nations, resulting from the outcome of any game of chance. Notice is hereby given that we are not responsible for: the improper use of equipment by you or any other person or business; for any loss caused to any person or business whatsoever as the result of the outcome of any game of chance or any person claiming an interest in the outcome of any game of chance; any malfunction, accident, defect in manufacturing, flaw, bias or damage, discovered or alleged in any item sold by us after it has been placed into use by the buyer or any other person associated with the buyer. J. Customer agrees to use and store their gaming items safely and securely By purchasing equipment from us, you expressly agree to: use and store these items safely and securely; to keep these items out of the reach of all minor children at all times; and to take all necessary precautions to ensure that the items may not be accessed by any child or other person who may cause injury to themselves or others by accidentally ingesting any item, throwing or dropping any item, or doing any other thing which may result in injury to themselves or another; and you assume all responsibility for the careful supervision of those who are in the presence of your items in order to avoid such injury. K. Customer expressly agrees to use according to accepted gaming rules We recommend, require and assume that you: know and understand the proper use of the equipment purchased and rules of the game(s) in which it is used, or agree to learn the proper use of the equipment and game rules prior to using it at any event open to the public; test the items to make sure they operate correctly, accurately and fairly before placing them in play at any event open to the public; conduct routine inspection and maintenance to insure that the item(s) continue to work properly; and use the equipment fairly and according to all laws and accepted rules of the game for which the equipment was manufactured. L. Customer expressly agrees to inspect items upon receipt When you purchase an item from us, we assume that you inspect the item for damage or flaws prior to using the equipment in any game of chance. If any material issues are discovered with any equipment you purchase from us, we require that you report the damage to us immediately upon discovery, and not use the item in any game of chance. We will work with you to resolve the issue, either by repair or replacement. M. Returns and Refunds We strive to create and sell only the best items at the Key West Resort & Casino, and hope you are always pleased with your purchase and enjoy your items for many years to come. If you are not completely satisfied with an item in your order, you may return the item within a reasonable time for a refund. (Opened and used playing cards may not be returned for a refund.) Refunds will be issued when the item is returned to us, in a form similar to your payment. (For example, if you paid by Paypal, your refund will be issued through Paypal.) To qualify for a refund, the item should be shipped to us no later than 10 days after you receive it. After that time, we assume the item arrived in good condition and you are happy with your purchase. To notify us of an issue with an item in your order, please e-mail [email protected]. |
Shipping:
We endeavor to ship your order within 72 hours, and can usually ship in-stock items within 24 to 48 hours of your placement of the order. If an item is out of stock, we will notify you within those times of the status of your order, and when we expect to be able to ship your order.
Domestic shipping:
We ship items within the United States via the most direct, prompt and economical method available. We generally use U.S. Postal Service "Flat Rate" boxes or UPS for shipments of goods within the United States. Flat Rate boxes are insured up to $50 in value. A customer may elect to increase the value of the insurance on a domestic shipping by requesting to do so and paying any additional insurance fee charged by the U.S. Postal Service for the increased insurance. If the customer does not opt to pay for additional insurance, the shipment will be considered insured for $50. We consider the remaining value of the shipment to be self-insured by the customer.
International Shipping:
The cost of international shipping has drastically increased in the past several years. Customers outside the United States should carefully consider the risks involved in purchasing items and having them shipped internationally. In many countries, insurance is not available for shipments from the United States.
In all cases, we consider our obligation in any transaction to be completed when we ship the item to our customer. If the shipment is lost or stolen, or its contents damaged in transit, we consider the shipment to have been self-insured by the customer. A customer whose destination address is in a country where insurance is available (Canada and some parts of the United Kingdom), may opt to purchase insurance for their shipment from the U.S. Postal Service. We will insure such shipments at the customer's request and expense.
If a customer outside the United States does not purchase additional insurance, we consider that customer's shipment to be self-insured against any theft, loss or damage.
Compliance with customs laws and regulations
Our company complies with all customs laws and regulations. We complete the proper forms to ship your items accurately. We cannot and will not falsify a customs form to save a customer their jurisdictional tax. (See below.)
Requests to alter customs declarations
Occasionally, a potential customer outside the United States will inquire about our products and request that we falsify the customs declaration, either by declaring the item a gift or by reducing the value of the item(s) in the shipment to less than actual their value in order to save the customer part of a local or national tax in their jurisdiction. Such an action is, by definition, a serious crime in the United States. We we will not honor any such request. In any case where a potential customer communicates such a request to us, we will immediately cancel the transaction and refuse to do any business with that person in the future. There will be no exception to this policy.

Making purchases on credit
We offer to permit customers to make certain purchases on credit and pay for their items over a specific amount of time, usually 60 or 90 days. The granting of credit is based solely on the customer's record of successful transactions with our company and an evaluation of the transaction to determine our risk, based on the wholesale and retail price(s) of the item(s) bought on credit. Our company's decision to extend or decline credit may also be based solely on our ability to supply the desired item to the customer on time and meet the terms of payment set by our suppliers, and not necessarily on the customer's ability to repay the debt. If we decline to enter into a credit transaction with any customer, that decision should not be construed as related to the personal credit worthiness of the customer. We do not charge interest for credit repaid on time according to the terms of the payment agreement.
Default on credit:
Customers who request and receive credit but fail to repay the amount owed according to the agreed terms will be charged interest at prevailing rates by our company and are responsible for the payment of any costs or fees charged to our company by third parties as a result of their failure to pay. Issuing a worthless check to repay credit is considered non-payment, and may, under certain circumstances, be a violation of criminal law. In all such cases, the matter will be within the jurisdiction of the courts of the State of Delaware, and the Delaware Criminal Code may apply.
Gift certificates purchased on our site
We offer guests the opportunity to purchase Paypal Gift Certificates to pay for goods on our site. We use Paypal for this function because it's easy for the recipient to redeem the value of the gift at checkout. The cards are a function of Paypal, and are subject to Paypal's policies about their use. When you purchase a gift card on our site, it may be e-mailed to the recipient, or printed and mailed or delivered in person to the gift recipient. We are not responsible for gift cards which are printed and lost, or if the value of the gift certificate is redeemed by someone other than the intended recipient. We will attempt to assist any customer who loses the value of their gift certificate, but cannot replace lost or stolen cards
Deposits to our company
Guests may make deposits directly to our company for their purchases, or for gifts to others, free of charge. Deposits are limited to $1,000 each and cannot exceed $5,000 in one year. If you wish to deposit money with us for your own use or as a gift to someone, e-mail [email protected].
Key West Resort & Casino "live" casino chips
To promote our company and the Key West Resort & Casino brand of gaming chips and other items, we occasionally issue a limited number of distinct casino chips which may be purchased from or redeemed with our company at face value. We call these chips "live" chips. Similar to a retail store's gift cards, these chips can be returned in exchange for their face value in cash or used to purchase merchandise on our site. The following rules apply to the purchase, ownership and redemption of live chips:
We consider each chip to be a claim check for the exact face value, left on deposit with our company and payable, without interest, at any time upon request. The buyer may: keep the chip; or may legally transfer ownership of the chip and its value to another person; or may redeem the chip for its face value by returning it to our company. We agree to pay the face value to anyone who delivers the chip to us in good condition using reasonable procedures established for this purpose.
Our company reserved the right to decline to cash any live casino chip we believe to be stolen, counterfeit, or so badly worn or damaged as to be unusable for its intended purpose. Legitimate owners of our live chips should report theft of the chip(s) to law enforcement, and then to us.
Our company will consider a casino chip to be "live," and worth its face value, when the chip is issued to a patron who has paid its face value to us, and until it is redeemed by that person or a legitimate successor. A legitimate successor is a person who has received the chip under lawful circumstances.
Our company will not cancel, or deem worthless, a specific issue of live chips unless and until all of the chips of that issue are redeemed and are in the possession of our company. In the event that the number of chips returned to us for redemption exceed the number of chips issued by us, we reserve the right to cash live chips only for patrons known to us as the purchasers of live chips.
Key West "live" $1 and $2 chips
Our company has issued a limited number of $1 and $2 casino chips that may be purchased or redeemed for their face value. We call these chips "live" chips. Our $1 chips are imperial blue casino chips with yellow 312 edge spots and our $1 Key West Resort & Casino inlay. Our $2 chips are light blue with white 312 edge spots and our $2 Key West inlay.
In order to purchase these chips, you must deliver to us an amount equal to the face value of each chip -- $1 for $1 chips and $2 for $2 chips -- in cash, valid check or valid money order payable to Continental Card & Game Company. Because the each may be immediately redeemed for its face value, we must have that amount stored at our company in order to pay the value of the chip, should it be redeemed. Any other forms of payment, such as a payment service which charges fees, may be subject to additional fee equal to the cost of using that form of payment.
Reasonable limits on the purchase of live chips
Because our live chips cost more than their face value to produce, we've set reasonable limits on the purchase of these chips by our customers. These chips are intended to be part of a larger, playable set of casino chips. We do not issue entire sets composed of a single denomination unless the customer has arranged in advance for the production of such as set with us. Generally, single live $1 and $2 chips may be purchased when a customer is buying a sample set of at least nine other denominated chips; and any denomination of $1 and $2 chips may not comprise more than 33 percent of the total number of chips purchased in any one order. We reserve the right to decline any order for live or other casino chips or table gaming supplies at any time at our discretion for any reason.
A. Membership
Membership in the Key West Resort & Casino Keynote Club is awarded at the discretion of the owner of Continental Games, LLC. The owner awards membership in the club to customers who make significant purchases in any number of transactions during a calendar year, and to longtime frequent customers who own and use a large quantity of Key West chips and other products in their hosted events. Members access club benefits through a password-protected page on our website. When a customer becomes eligible for membership, the password is sent to the member via e-mail. B. Membership expiration Memberships expire at midnight on December 31 of the current year. C. Membership benefits All members of the Keynote Club are eligible to receive the same benefits during membership. Keynote Club members access their rewards on a password-protected page on our website. Keynote Club member benefits may be added, changed, limited or removed from the list of current benefits at any time, at the discretion of our company. D. List of current benefits 1. All club members receive password access to the Keynote Club page. 2. All club members receive a discount equal to the cost of U.S. shipping for one U.S. Postal Service small flat rate box (currently $8.30) on one order per year if the item(s) shipped fits into a small flat rate box. On all other orders, the member will receive a discount equal to 5 percent of the total shipping cost of their order as calculated on the U.S. Postal Service's public "Price Calculator" website. 3. All Keynote Club members earn one (1) Key West Resort & Casino chip per quarter, for a total of four (4) casino chips per year. Ending dates for the quarter are: March 31, June 30, September 30 and December 31. When requesting this benefit, the member may select any chip(s) from among those for sale by our company, denominated or roulette. 4. Members may earn additional casino chips by contributing to the site page as needed, such as writing an approved article or performing some service to our business. Opportunities to earn chips in this manner will be posted. Unsolicited offerings are at the discretion of the casino owner. 5. All members may access the Keynote Club page to view or purchase items which are not yet available for sale on the public pages of this site. 6. All members are eligible to enter any contest shown on the club page. The contest winner is selected at random from among members who provide the correct answer or fulfill the requirements of that month's contest. The prize awarded in each contest is completely free to the member, and the cost of shipping any prize is borne by our company. 7. A contest winner may elect to receive the cash equivalent value of their prize, either by mailed check, Paypal, or cash on account with the casino. 8. Keynote Club members will be invited to attend any live events hosted by our company. 9. Keynote Club members have access to "The Drawing Board," where they can view new projects and assist in developing them. This page is not listed in the navigation bar, but is accessible using a button on the password-protected club page. 10. From time to time, our company may provide items or services for free to members who make purchases during the month. These items will be included in the member's order package. If the items are of limited quantity, the complimentary items are awarded on a first-come, first-serve basis until they are gone, at which time the offer of the complimentary item is withdrawn. E. Privacy of Customer Information
We maintain normal business records of our customer transactions, including the names and addresses of our customers and the specific items they've purchased. In accordance with Delaware's Data Breach law (H.B. 180), we keep these records securely, and take all reasonable measures to safeguard them. Our customer list is stored electronically on a stand-alone, 256-bit encrypted hard drive, which is kept separately from the encryption key. The device we employ is also used by the U.S. military to securely store sensitive data.
We do not share this information with anyone for any reason. We are required by law to permit inspection of these records when requested by authorized federal law enforcement officials. This inspection is reasonably limited to certain controlled gambling devices. To date, no such inspection has been requested by any agency, and no information has been shared.
We do not collect or store customer account numbers from credit cards, debit cards, or banks. Instead, we use Paypal to conduct transactions securely.
We do not disclose your name or address to any other guests. When asked by a customer for the purpose of home game security, we will advised them if another customer living near them owns a significant number of our Key West Resort & Casino chips or playing cards. In the event that we advise a customer that another customer in their area has chips or playing cards, we do not disclose the identity of either person, and do not disclose that the inquiry was made.
We do not sell or give any customer information to anyone for any reason, such as mailing lists or telemarketing.
Posting of personal information by visitors
We suggest that visitors to our site not post their personal information in any public area, and use caution if providing this information to others through the PM feature for any reason. We recommend that safe "best practices" be used in order to avoid putting yourself at risk in the conduct of your personal business, either here or elsewhere online or in person. Posting comments on our site:
We encourage and welcome comments and suggestions from our guests. Guests may visit the site's "Forum" section to read posts made by others without registering as a member of the forum. Guests who elect to register may create their own username and password. Guests who are registered members of the forum may post comments, create new topics, send messages to other members, and otherwise use all features available in the forum at no cost.

In order to promote the atmosphere of a casino for the entertainment of our customers, we use terms on our site which are commonly used in the casino industry. These terms have no relationship to any real casino.
Prizes awarded on this site
To promote our business, we hold promotional contests on this site. No purchase is required to enter any of our contests. Prizes are delivered to the winner without charge for shipping or any fee of any kind. If you win one of our contests, you will not be asked to pay any fee for anything, and are not prohibited from entering subsequent contests. Unless otherwise noted, guests may submit one contest entry per contest. Guests who reside in the same household may each submit one entry. All members who enter a given contest have an equal chance of winning, and the odds vary with each contest, based on the number of people who enter. Anyone found to have cheated in an attempt to win any contest will be disqualified and banned from our site, as this deprives other patrons of their fair chance to win.
